Lawsuit Filed on Behalf of Oil and Gas Inspectors at AmSpec, Announces Morgan & Morgan

February 20, 2011 (Fort Lauderdale, FL) -- Elliott v. AmSpec Services, L.L.C., a lawsuit involving allegations of unpaid overtime wages and violations of the Fair Labor Standards Act, has been filed as a collective action in federal court in New Jersey. The Plaintiffs in this action, represented by Andrew Frisch of Morgan and Morgan, are Oil, Gas, and Chemical Inspectors who claim that they did not receive proper compensation for overtime hours worked.

Elliott v. AmSpec Services, L.L.C. (Case Number: 2:2010cv06575) was filed on December 16, 2010, in the District of New Jersey. The presiding judge is Judge Dennis M. Cavanaugh.

In this collective action lawsuit, the Oil, Gas, and Chemical (OGC) Inspectors allege that AmSpec Services, L.L.C. violated the Fair Labor Standards Act by failing to properly compensate them for overtime hours. The OGC Inspectors were responsible for inspecting incoming shipments of oil, gas, and chemicals at coastal locations. Although they regularly worked over forty hours per week, the Defendant did not properly compensate them for those hours. Instead, they were paid only "half-time" or "Chinese Overtime," rather than time-and-a-half.

Morgan and Morgan overtime attorney Andrew R. According to a federal law known as the Fair Labor Standards Act (FLSA), non-exempt employees are entitled to time-and-a-half pay for all hours worked over forty in a given workweek. A pay practice that is similar to the one practiced by Amspec Services, L.L.C. was previously been found to be illegal in another overtime lawsuit handled by Morgan and Morgan, Adeva v. Intertek.

All unpaid overtime claims filed by OGC Inspectors who worked for AmSpec Services, L.L.C. within the last three (3) years and whom were paid the "Chinese Overtime" are eligible to join the case.
