Baby Blanket Distributor threatened by Pet Product Distributor? You’ve Got To Be “Kidding”, right?!

Miracle Blanket threatens YourTreasuredPet.com with legal action because they feel that baby blanket buyers may get confused with pet blankets.

YourTreasuredPet.com, a division of First FountainHead Group, LLC, exclusive internet distributor of America’s own pet blanket manufacturer, Invisible Health Inc, was alleged to be a threat to one of America’s largest BABY BLANKET distributors. Initially thought to be an April fool’s prank, it proved to be real.

YourTreasuredPet.com received a demand to cease and desist using MIRACLE PET BLANKET as a proposed trade name. Mr. Michael Gatten, owner of the trade name MIRACLE BLANKET, a baby swaddling blanket, apparently feels that the term MIRACLE PET BLANKET poses a threat to his baby blanket distribution organization. Counsel for Mr. Gatten feels that use of the term Miracle Pet Blanket is a violation and infringes upon the trade name "Miracle Blanket"

Even though counsel for YourTreasuredPet.com believes that Mr. Gatten would have a hard time enforcing his cease and desist demands, Company Chairman, Mr. Elroy E. Erie, has decided not to take the route of possible litigation, as threatened by Mr. Gatten’s counsel.

"We do not - in any way - feel that we infringe upon any trademarks held by Mr. Gatten or anyone else. We were very clear and specific in our proposed trademark, which was being test-marketed. We certainly could be interested in dialogue with Mr. Gatten to learn in what way Miracle Blanket for babies could be affected in any way by MIRACLE PET BLANKET, clearly a product for pets."

"In a show of good faith, YourTreasuredPet.com is now distributing its blankets as PERFECT PET BLANKET, a trade mark held for some time. We have already deleted the term MIRACLE PET BLANKET from our website."

Mr. Erie continued: "We certainly believe that we would prevail if forced to defend our position in court. Rather, we feel that our energy and resources are best utilized by concentrating on the success of our product lines and building our Affiliate Program. By the time this would arrive in court, we will have served many more people in a positive way. Perhaps Mr. Gatten’s counsel could have suggested a more amicable approach, which would surely have received a more positive response from us. Instead, he chose a hostile approach from the outset, knowing full well that it has little chance of succeeding."

Mr. Erie concluded by wishing Mr. Gatten all success with his ventures and hopes that this approach by Your Treasured Pet will contribute to a mutually beneficial outcome for all parties.
